VOLUNTEER RELEASE AND WAIVER
I know that participating in a road race as a runner or a volunteer is a potentially hazardous activity, which could cause injury or death. I will not participate unless I am medically able and properly trained, and by executing this document, I certify that I am medically and physically able to perform this event as a volunteer. I agree to abide by any decision of race officials relative to any aspect of my participation in this event, including the right of any official to deny my participation for any reason whatsoever. I attest that I have read the rules and responsibilities of a race day volunteer and agree to abide by them. I assume all risks associated with participating in this event, including, but not limited to falls, contact with other participants, the effects of weather, vehicular traffic and the conditions of the road and adverse health effects caused by my participation.
Having read this waiver and knowing these facts and in consideration of the acceptance of my entry, I, for myself and anyone entitled to act on my behalf, my heirs, successors and assigns, hereby waive and release The Buck Fifty, Inc., Adena Health System, and/or the State of Ohio, Ohio Department of Natural Resources, or any of their officers, directors, volunteers, employees, agents, successors, sponsors and trustees from any and all claims, demands, losses, damages or liabilities that I, my assignees, heirs, distributes, guardians, next of kin, spouse or legal representative have or may have in the future, of any kind arising, out of or related to my participation in this event, even though that liability may arise out of negligence or carelessness on the part of the entities or individuals named in this waiver.
I further agree and covenant not to sue The Buck Fifty, Inc., Adena Health System, and/or the State of Ohio, Ohio Department of Natural Resources, or any of their officers, directors, volunteers, employees, sponsors, owners of real property over which the race is conducted, and agents for any and all claims, demands, losses, damages rights and/or causes of action which may arise as a result of my participation in this event, of any kind or nature whatsoever, and such covenant shall apply also to my heirs, successors, personal representatives and assigns.
I further expressly agree that this release and waiver agreement is intended to be as broad and inclusive as is permitted by the law of the State in which the event is conducted and that if any portion is held invalid, it is agreed that the balance shall, notwithstanding continue in full legal force and effect.
This release and waiver agreement applies to the following event:
The Buck Fifty is an open road and trail relay race covering 150 miles in Ross County, Ohio.
I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTEERING WITHOUT ANY INDUCEMENT, ASSURACE, OR GUARANTEE BEING MADE.
