TURQUOISE CIRCUIT FINALS RODEO
VOLUNTEER POLICY, ASSUMPTION OF RISK, RELEASE OF LIABILITY, AND INDEMNIFICATION AGREEMENT
This Volunteer Policy, Assumption of Risk, Release of Liability, and Indemnification Agreement (“Agreement”) applies to every person volunteering for the Turquoise Circuit Finals Rodeo (“Event”).
VOLUNTEER POLICIES
1. Volunteer Credentials
Volunteer credentials are issued solely to the assigned volunteer and may not be transferred, loaned, copied, shared, or used by any other person. A volunteer who permits another person to use volunteer credentials for admission or access may be held responsible and may be immediately dismissed from volunteer service.
2. Dress Code
Volunteers must comply with the dress code and appearance requirements established for their assigned position. The Event may provide specific clothing or instructions based on the volunteer’s duties and work area.
3. Minimum Age
Volunteers must be at least sixteen (16) years old to serve on a committee or in an assigned volunteer position. A parent or legal guardian must sign this Agreement for any volunteer under eighteen (18) years old.
4. Alcohol and Security Assignments
Volunteers must be at least twenty-one (21) years old to work in any area where alcoholic beverages are served, sold, distributed, possessed, or handled, or to serve in a security position.
A volunteer under twenty-one (21) years old may not consume, possess, serve, distribute, transport, or handle alcoholic beverages at any time. Violation of this rule will result in immediate dismissal and permanent disqualification from volunteering for the Event.
5. Conduct and Instructions
Volunteers must act professionally, follow all safety rules, obey instructions from authorized Event personnel, remain within assigned areas, and refrain from conduct that may endanger themselves or others.
The Event may reassign, suspend, or dismiss any volunteer at any time, with or without cause.
6. No Employment Relationship
Volunteer service is voluntary and does not create an employment, agency, partnership, joint-venture, or independent-contractor relationship. Unless otherwise agreed in writing, volunteers are not entitled to wages, benefits, workers’ compensation benefits, insurance coverage, or reimbursement of expenses.
ASSUMPTION OF RISK
I understand and acknowledge that rodeos, livestock events, equestrian activities, agricultural events, entertainment events, and related volunteer activities are inherently dangerous.
My volunteer duties may place me in or near arenas, competition areas, chutes, pens, stalls, livestock holding areas, loading areas, parking areas, restricted-access areas, concession areas, alcohol-service areas, public gathering areas, equipment, vehicles, machinery, temporary structures, uneven surfaces, crowds, and unpredictable animals.
Risks include, without limitation:
- Being kicked, bitten, stepped on, trampled, struck, crushed, thrown, dragged, or otherwise injured by an animal;
- Collisions with animals, vehicles, equipment, gates, fencing, structures, participants, spectators, or other volunteers;
- Slips, trips, falls, lifting injuries, weather exposure, dust, noise, smoke, fire, electrical hazards, communicable illnesses, crowd activity, negligent acts, and security incidents;
- Property damage, bodily injury, illness, disability, emotional distress, paralysis, or death; and
- Risks that are known, unknown, anticipated, unanticipated, obvious, hidden, natural, or caused by the acts or omissions of others.
I voluntarily choose to participate with full knowledge of these risks. I knowingly and freely accept and assume all risks associated with my volunteer service, whether caused by natural conditions, animals, equipment, other persons, ordinary negligence, or any other cause, to the fullest extent permitted by law.
RELEASE AND WAIVER OF LIABILITY
In consideration for being permitted to volunteer for or participate in activities connected with the Event, I, on behalf of myself and my spouse, children, parents, guardians, heirs, estate, personal representatives, beneficiaries, successors, and assigns, fully and permanently release, waive, discharge, and covenant not to sue the following persons and entities, collectively referred to as the “Released Parties”:
- Turquoise Circuit Finals Rodeo;
- The Event venue and property on which any Event-related activity occurs;
- The owners, landlords, tenants, operators, managers, and lessors of the venue or property;
- Event producers, promoters, organizers, committees, associations, sanctioning bodies, and affiliated organizations;
- Sponsors, advertisers, vendors, concessionaires, exhibitors, contractors, subcontractors, service providers, and suppliers;
- Rodeo participants, contestants, stock contractors, livestock owners, judges, officials, laborers, security personnel, medical personnel, photographers, media representatives, employees, agents, representatives, directors, officers, members, volunteers, and guests;
- Governmental entities or public agencies providing facilities or services; and
- Every other person or organization directly or indirectly affiliated with, connected to, participating in, supporting, hosting, sponsoring, producing, operating, or providing services for the Event.
To the fullest extent permitted by law, none of the Released Parties shall be responsible or liable for any injury, illness, death, loss, theft, property damage, expense, claim, demand, action, or other damage arising from or related to my volunteer service, presence at the Event, transportation connected with the Event, or participation in any Event-related activity.
This release applies even when a claim is alleged to have resulted, in whole or in part, from the ordinary negligence, acts, omissions, supervision, premises conditions, equipment, animals, or conduct of one or more Released Parties. This Agreement does not release liability that cannot lawfully be waived under applicable law.
INDEMNIFICATION AND HOLD HARMLESS
I agree to defend, indemnify, and hold harmless the Released Parties from and against any claims, demands, lawsuits, liabilities, judgments, losses, damages, settlements, penalties, costs, or expenses, including reasonable attorneys’ fees, arising directly or indirectly from:
1. My acts, omissions, negligence, misconduct, or violation of Event policies;
2. Any injury or damage caused by me;
3. My breach of any representation, promise, or obligation contained in this Agreement; or
4. Any claim brought by or on behalf of me, my family, my estate, or any other person claiming through me.
MEDICAL TREATMENT
If I become injured or ill, I authorize Event personnel to obtain emergency medical assistance for me when reasonably necessary. I understand that the Released Parties are not obligated to provide medical care or transportation.
I accept full financial responsibility for all medical treatment, ambulance services, transportation, hospitalization, medication, or other expenses incurred on my behalf. I release the Released Parties from liability arising from the provision, delay, failure, or refusal of emergency or medical assistance, to the fullest extent permitted by law.
PERSONAL PROPERTY
I am solely responsible for my clothing, equipment, vehicle, electronic devices, valuables, and other personal property. The Released Parties are not responsible for any lost, stolen, misplaced, damaged, or destroyed property.
PHOTOGRAPHY AND PUBLICITY RELEASE
I authorize the Event and its sponsors, affiliates, representatives, and media partners to photograph, film, record, reproduce, publish, display, and use my name, image, likeness, voice, and volunteer participation for lawful promotional, advertising, documentary, archival, broadcast, social-media, or other Event-related purposes without compensation or further approval.
COMPLIANCE WITH RULES
I agree to follow all Event policies, safety requirements, venue rules, laws, and instructions from authorized personnel. I understand that failure to comply may result in immediate removal from my assignment or the Event premises.
I agree to promptly report unsafe conditions, injuries, incidents, credential misuse, harassment, alcohol violations, or other serious concerns to an authorized Event representative.
GOVERNING LAW AND SEVERABILITY
This Agreement shall be interpreted and enforced under the laws of the state in which the Event is held.
If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Any invalid provision shall be modified only to the minimum extent necessary to make it enforceable while preserving its intended purpose.
This Agreement is intended to be as broad and inclusive as permitted by applicable law.
ACKNOWLEDGMENT AND ACCEPTANCE
By completing and submitting this volunteer form to perform volunteer work, I acknowledge that I have read, understand, and agree to the terms of this waiver, and I confirm that:
- I have carefully read and understand this Agreement;
- I understand that I am giving up substantial legal rights, including the right to sue the Released Parties;
- I understand the risks associated with rodeos, livestock, crowds, restricted areas, equipment, and volunteer activities;
- I voluntarily assume all such risks;
- I have had the opportunity to ask questions and seek independent legal advice;
- I am signing or accepting this Agreement freely and voluntarily; and
- No oral statement or promise has been made to me that changes the terms of this Agreement.
